Acceptance of Terms

By accessing and using cartilagezyjoint.world and enrolling in our Spanish language courses, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all users of Cartilagezyjoint, including students, visitors, and anyone who accesses our online learning platform.

Course Enrollment

Enrollment in our Spanish courses requires completion of the registration process and payment of applicable fees. By enrolling, you confirm that all information provided is accurate and complete.

Course availability is subject to minimum enrollment numbers and instructor availability. Cartilagezyjoint reserves the right to cancel or reschedule classes with appropriate notice to enrolled students.

Students must be at least 18 years of age to enroll in our adult Spanish language programs. Proof of age may be requested during registration.

Payment Terms

Course fees must be paid in full before accessing classes and materials. We accept payment via credit card, debit card, or bank transfer as specified during enrollment.

Monthly package fees are charged on a recurring basis until you cancel your enrollment. You are responsible for maintaining current payment information.

All prices are listed in Australian Dollars and include applicable taxes. Cartilagezyjoint reserves the right to adjust pricing with notice to current students.

Class Attendance

Students are expected to attend scheduled classes punctually. Regular attendance is essential for language learning progress and maximizing the value of your course investment.

If you need to miss a class, please notify us at least 24 hours in advance. We will provide access to the class recording so you can review the material independently.

Rescheduling requests should be submitted with adequate notice. While we strive to accommodate scheduling changes, alternative time slots are subject to availability.

User Conduct

Students must conduct themselves respectfully during all interactions with instructors and fellow learners. Cartilagezyjoint maintains a supportive learning environment free from harassment or discriminatory behavior.

You may not record classes without explicit permission from the instructor and all participants. Course materials provided by cartilagezyjoint are for personal use only and may not be shared or distributed.

Disruptive behavior or violations of these conduct standards may result in removal from classes without refund of fees paid.

Acceptable Use

When using our platform and services, you agree to:

  • Use the platform only for lawful purposes and in accordance with these Terms of Use.
  • Provide accurate and complete information during registration and enrollment.
  • Maintain the security and confidentiality of your account credentials.
  • Respect the intellectual property rights of Cartilagezyjoint and third parties.
  • Not attempt to gain unauthorized access to our systems or other users' accounts.
  • Not transmit any viruses, malware, or harmful code through our platform.
  • Not use automated systems to access our services without prior written permission.
  • Not interfere with or disrupt the operation of our platform or servers.
  • Not use our services to engage in any fraudulent, abusive, or illegal activities.
  • Not impersonate any person or entity or misrepresent your affiliation with any person or entity.

Violation of these acceptable use provisions may result in immediate termination of your account and access to our services, without refund of fees paid.

Intellectual Property

All course materials, including videos, documents, audio files, and exercises, are the property of Cartilagezyjoint or our licensed content providers.

You are granted a limited, non-transferable license to access and use course materials for personal language learning purposes. You may not reproduce, distribute, or create derivative works from our materials.

The Cartilagezyjoint name, logo, and branding are protected trademarks. Unauthorized use of our intellectual property is prohibited.

Platform Access

We provide access to our online learning platform for the duration of your course enrollment. You are responsible for maintaining the security of your login credentials.

Cartilagezyjoint is not liable for unauthorized access to your account resulting from failure to protect your password. Notify us immediately if you suspect unauthorized use of your account.

We reserve the right to suspend platform access for maintenance, security updates, or technical issues. We will provide advance notice when possible and minimize disruption to scheduled classes.

Cancellation and Refunds

Students may cancel their enrollment according to the terms specified in our Return Policy. Cancellation requests must be submitted in writing to clients@cartilagezyjoint.world.

Refund eligibility depends on the timing of cancellation and number of classes attended. Please review our Return Policy for detailed information on refund conditions.

Disclaimers

While we strive to provide high-quality Spanish language instruction, Cartilagezyjoint cannot guarantee specific learning outcomes. Individual progress depends on factors including study time, practice, and personal aptitude.

Our courses are designed for language learning purposes. We do not provide academic credit, professional certifications, or qualifications unless explicitly stated.

Technical issues may occasionally affect platform availability or class quality. We work to resolve problems quickly but are not liable for minor interruptions in service.

Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable Australian legislation, Cartilagezyjoint liability is limited to:

  • The amount paid for courses during the period in which an issue occurred, or
  • At our option, the resupply of the services or payment of the cost of resupplying the services.

We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, except where such liability cannot be excluded under the Australian Consumer Law.

Students participate in online classes at their own risk. We are not responsible for technical issues with your internet connection, computer equipment, or software.

Nothing in these Terms of Use excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable Australian consumer protection legislation that cannot be excluded, restricted, or modified.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services repaired or replaced if the services fail to be of acceptable quality and the failure does not amount to a major failure.

Privacy

Your use of our services is subject to our Privacy Policy, which explains how we collect and use personal information. By accepting these Terms of Use, you also agree to our privacy practices.

Changes to Terms

Cartilagezyjoint may modify these Terms of Use periodically. We will notify enrolled students of significant changes via email. Continued use of our services after changes constitutes acceptance of updated terms.

Dispute Resolution

If you have a complaint or dispute regarding our services, we encourage you to contact us first to resolve the matter directly. We are committed to addressing your concerns promptly and fairly.

If we cannot resolve a dispute through direct communication, you may:

  • Contact the Australian Competition and Consumer Commission (ACCC) for consumer protection matters.
  • Seek assistance from your state or territory consumer protection agency.
  • Engage in alternative dispute resolution processes, such as mediation, before pursuing legal action.

Nothing in this section prevents you from exercising your rights under the Australian Consumer Law or other applicable Australian legislation.

Applicable Law

These Terms of Use are governed by the laws of South Australia and the Commonwealth of Australia, including:

  • The Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth))
  • The Privacy Act 1988 (Cth) and the Australian Privacy Principles
  • Other applicable Australian federal and state legislation

Any disputes arising from these terms or use of our services will be resolved in accordance with Australian law. The courts of South Australia will have exclusive jurisdiction over any legal proceedings, subject to your rights under the Australian Consumer Law to bring proceedings in other Australian courts.
